T-mobile warranty policy

Happy Holidays. I just got finished with a representative and let her know I am highly displeased.  I signed a contract as a new customer in September it is now December and the brand new phone they shipped turns on and off and shuts off. I called and explained this the representative in accounts told me they can not promise a 100% phone because it is an electronic device. I explained to her that the phone has been acting up for three weeks I have been sending HTC error reports and those dont work. The reason I am writing this note is because I am being charged 20 dollars to have them ship me a phone and for me to return it. I have brought phones from non contract companies that work better. I feel that becasue the phone is not even 3months old that it should've been a free charge. I explained  to her I can go to the store for free and show them the problem and they can give me a new one for free. She advised me that if I did not send the phone back and if I went into the Tmobile store I would have to pay for a new phone altogether. Highly displeased.
